On 26 June, Gustavo Moser delivered a presentation titled ‘The Oki Data Test – Past, Present and Future?’ as part of the webinar ‘The Oki Data Test in the Age of AI’, organised in partnership with the Canadian International Internet Dispute Resolution Centre (CIIDRC). Gustavo explored the fundamentals of the Oki Data Test, originally established in 2001, and examined the evolution of case law from typical to more atypical scenarios. He concluded by leaving the audience with reflective questions, fast forwarding 20 years into the future of the test:
- With the widespread use of the Internet, market volatility and proliferation of services in the Age of AI, is there a need to ‘regulate’ unathorised dealers, resellers, distributors, or agents?
- Does the ‘monolithic’ application of the Oki Data Test make sense across all industry segments?
- Should we rethink the Test to accommodate the atypical nature of scenarios, especially with the advent of new technologies?
