The piece examines proposed measures to enhance efficiency, certainty and party autonomy – such as an opt-in right of appeal on points of law, codifying the governing law of the arbitration agreements, and judicial review of jurisdictional rulings – while assessing how these reforms align with global trends yet depart from English law in key respects.
